Chief Magistrate Judy Latchman on Monday refused an application by prosecutors for the United States (US) in the extradition proceedings for bail to be refused to Opposition Leader Azruddin because of a “pattern” of alleged offences.
“I do not find that past conduct without a conviction or pending charges without a conviction is sufficient to warrant a revocation of bail,” she said in her decision. The Chief Magistrate said if the younger Mohamed and his father, Nazar Mohamed who are subject of the extradition proceedings, are convicted while the extradition matter is still ongoing, “that conviction may very well have some bearing on an application for revocation at that stage.”
Having heard all the arguments, Ms Latchman said the court has the authority to grant, vary, or even revoke bail. She also found that tat court has the authority to vary bail conditions or revoke bail conditions. “In these circumstances, bail is maintained for the Mohameds in relation to this matter,” she said.
Jamaican lawyer Herbert Mc Kenzie, one of the prosecutors for the United States’ extradition hearing for Mr Mohamed and his father Nazar Mohamed, cited several recent charges instituted on Mr Mohamed as grounds for the revocation of bail.
One of those included attempting to pervert the course of justice by, along with two others, discharging a loaded firearm on October 12, 2026 near the residence of a major witness in the extradition hearing, police intelligence chief Senior Superintendent Prem Narine.
Her decision followed after hearing submissions from lawyers Roysdale Forde and Siand Dhurjon.
However, Mr Mohamed remains on remand until November 24 in relation to the offences allegedly committed on October 12. The other is the alleged possession of a firearm and alleged possession of ammunition.
The extradition hearing continues at 1 PM Monday. The entire morning session was taken up with the bail revocation application.
