City businessman, Rondy Jagdeo, who was accused of gunning down biker Kirk Davis late last year, on Thursday walked out of the Georgetown Magistrates Court a free man.
Chief Magistrate, Priya Sewnarine- Beharry ruled ruled that the prosecution failed to establish the elements of murder and so there was insufficient evidence to committ him to stand trial in the High Court by a judge and jury.
Jagdeo had been accused of gunning down Davis outside his Eccles home on September 3, 2013. An autopsy had revealed that Davis was shot 16 times. Shortly after, it was believed that Jagdeo had fled to neighbouring Suriname until he surrendered several weeks later at the Ruimveldt Police Station in the company of his lawyer.
Police Prosecutor, Bharat Magru told the court that despite despite several radio messages and the issuance of summons, the main witnesses- Rondell Marks and Alifa Dookie, the deceased girlfriend- they never appeared in court on several occasions. The prosecutor said he was relying on evidence placed before the court.
Defence Lawyer, Mark Waldron said the main witnesses had stated that there were other persons at the scene at the time and it would be speculating to say that Jagdeo had committed the offence.
