The announcement was made by former Attorney General, Anil Nandlall.
“They have tossed the procurement laws out of the window,” he told a news conference.
He further argued that there is no legal provision that allows government to go to second bidders. Nandlall said
The Finance Ministry has argued that Fedders-Lloyd had remained in contention as the second lowest evaluated bidder after Surendra Engineering which had been awarded the now scrapped contract.
However, the Health Ministry had three years ago stated that the National Procurement and Tender Administration Board had disqualified Fedders-Lloyd on administrative grounds.
“I know it is a fact that they were disqualified because at they submitted two prices for the samr project,” said Nandlall.
Government has already said it would be cheaper to award Fedders-Lloyd the contract because that company has agreed to build the facility at the originally tendered amount.
The Finance Ministry under the coalition administration has also said India has told government that the Specialty Hospital will be necessary to support primary health care. Also, government has argued that it would be too time consuming to re-tender the project that is being funded through a low-interest loan from India.
