Opposition Leader Azruddin Mohamed and two of his employees were Friday each granted bail of GY$750,000 on joint charges of illegal possession of one .32 pistol, illegal possession three matching rounds, and attempting to pervert the course of justice by discharging a firearm in the vicinity of Head of Police Special Branch, Senior Superintendent Prem Narine who is a witness in the extradition proceedings.
Magistrate Faith McGusty said each offence carried bail of GY$250,000.
The trio — Mr Mohamed, his driver Eugene Thorne and videographer Mario Mohamed — is accused of attempting to pervert the course of justice on October 12 for the administration of law by discharging a firearm at or in the vicinity of the residence of Mr Narine who is testifying in Mr Mohamed’s extradition proceedings.
They pleaded not guilty.
Mr Mohamed and his father, Nazar Mohamed, are wanted by the US for money laundering and other financial crimes linked to their gold trading business.
Several bail conditions were attached including staying away from Barr Street, Kitty where Mr Narine lives.
The defence team of Siand Dhurjon, Damien Da Silva and Roysdale Forde advanced several special reasons for granting bail to their clients.
Except for Mr Mohamed, whose travel document has been already surrendered to police as a bail condition in the extradition proceeding, the other two co-accused would have to similarly do so and also inform the court if they intend to apply for new ones.
The magistrate noted several issues, which were raised by the defence lawyers, just prior to stating that she would grant bail.
They are:
- where the firearm was found while Mr Dhurjon was at the Kitty Police Station
- after the first search of Mr Mohamed’s vehicle at the corner of Vlissengen Road and Sandy Babb Street, a second officer had driven the car to the police station
- that the charge reads that the firearm and ammunition were in possession of the men on Alexander Street rather than at the space where they were searched previously
- the prosecution was Friday unable to provide her with camera footage that suggests that the alleged explosion heard was in fact a gunshot
- the alleged explosion heard that is suspected to be a gunshot came from that particular vehicle
- differed with the prosecution on the point of multiple occupancy of the vehicle
- Mr Mohamed is on bail in another court and has been honouring those bail conditions
- prosecution’s request for three weeks to make disclosure of its evidence.
The bail conditions are:
- addresses of the co-accused are at and notification of the court if the men change their residences
- surrender of all passports and all travel documents
- no application for replacement of travel documents must be made without the court’s approval
- do not leave Guyana without the court’s permission
- provide work and telephone numbers and notify the court and the prosecution of any change in contact details
- the accused person shall not directly or indirectly contact, threaten, intimidate, or attempt to influence any prosecution witnesses concerning the cases
- the accused should not obstruct or interfere with the work of the prosecution
- report to the Kitty Police Station
- no contact between the accused or agents of the accused with Senior Police Superintendent Prem Narine and his immediate family members
- the accused should at all times remain a distance away from Mr. Naraine’s home and avoid Barr Street between Vlissengen Road and Alexander Street.
