Billionaire Guyanese gold dealers and exporters, Azruddin Mohamed and his father Nazar “Shell” Mohamed, who are wanted by the United States (US) for trial for alleged financial crimes, were on Monday reprimanded for reporting erratically every Friday between 1 pm and 3 pm, after concerns were raised by prosecutor for the United States (US) Attorney-at-Law Glen Hanoman.
Principal Magistrate Judy Latchman examined police records on their history of reporting and found that there were earlier and later instances than stipulated in the timeframe.
After hearing arguments from both sides, Ms Latchman varied the reporting order for the Mohameds to any time during Friday, excepting their court days.
They must enter the date and time in the police logbook on each required visit.
If they are absent due to illness, the magistrate said they must provide a medical certificate that must be lodged in the police property book.
If Friday is a holiday, the court ordered them to report on Thursday.
The Mohameds were asked by the magistrate to repeat the instructions. She was satisfied that they did.
The Principal Magistrate warned the man, who posted the bail of GY$150,000 bail each, that his money would be forfeited if the Mohameds violate the reporting procedures. “They will find themselves locked up on the next occasion and the bail will be forfeited, estreated,” she said.
Mr Hanoman, who brought the issue of unpunctual reporting, had earlier asked the court to ensure the Mohameds report frequently if she did not want to revoke bail on Monday.
Saying that he had participated in a number of extradition cases, Mr Hanoman said the Mohameds were “fortunate to have been granted bail.”
Defence lawyer, Roysdale Forde said rather than tightening the reporting rules, they “should be relaxed” to every fortnight.
Mr Forde and fellow defence lawyers Siand Dhurjon disagreed with Mr Hanoman’s claims, but the magistrate thanked him for bringing them to the Court’s attention.
