Former South American beauty queen, Carolan Lynch was Wednesday arraigned on a fresh charge of allegedly murdering her husband, a wealthy foreign exchange dealer.

Appearing in an all-black outfit and a pair of sunshades hooked on her blouse, the charge against Lynch was read to her by Chief Magistrate Priya Sewnarine-Beharry.

Lynch was not required to plea to the indictable charge that she murdered 44-year old Farouk Razac on May 7,2007. She was remanded to prison until February 5 when the date for the commencement of the Preliminary Inquiry would be set.

She appeared in court one day after surrendering to police to clear her name

The magistrate hopes that by that time the prosecution would obtain the file, state the number of witnesses and the expected length of the Preliminary Inquiry that would determine whether the accused should face trial by a judge and jury.

Defence Latchmie Rahamat urged the Chief Magistrate to hear the second Preliminary Inquiry. The first one was discharged in 2008 by then City Magistrate, Gordon Gilhuys because of insufficient evidence. The Director of Public Prosecutions (DPP) in 2010 recommended that the charge be instituted against the woman.

Rahamat was confident that this second murder charge would be discharged too because there is no fresh evidence. “There is definitely no new evidence that warrants her to be recharged,” she told the court.

Recalling that moves were made to the High Court between 2007 and 2008 for the prosecution to provide any new evidence, the lawyer said “the outcome will be the same” from this new charge.

Razac’s body was found in his Ireng Place, Bel Air Park home by his wife about 8:30 AM on May 7,2007 with a wound to his head and marks around his neck. At that time she had just returned from taking their daughter to school.
